1. Acceptance of Terms

By accessing and using Myanmar Art Space (https://myanmarartspace.net), you agree to comply with and be bound by these Terms of Service.

2. User Accounts and Roles

To access certain features, you must register an account. We categorize users into three distinct roles:

  • Collectors (Buyers): Individuals interested in viewing and purchasing Myanmar art. You agree to provide accurate shipping and payment information.
  • Artists (Sellers): Creators wishing to showcase and sell their original work. You warrant that you are the original creator of all artworks uploaded.
  • Galleries (Sellers): Entities representing multiple artists. You warrant that you have the legal right/authorization to sell the artworks listed on your profile.

3. Intellectual Property and Content

  • Ownership: Artists and Galleries retain full copyright and ownership of their physical artworks and digital images uploaded to the platform.
  • License to Platform: By uploading content, you grant Myanmar Art Space a non-exclusive, worldwide, royalty-free license to display, promote, and reproduce images of your artwork for marketing and platform operation purposes.
  • Prohibited Content: Users may not upload content that is offensive, defamatory, or violates the intellectual property rights of others.

4. Buying and Selling

  • Pricing: Sellers (Artists/Galleries) are responsible for setting the price of their artworks.
  • Commissions: Myanmar Art Space charges a service fee/commission on successful sales as agreed upon during the Artist/Gallery registration process. This fee is deducted from the final payout.
  • Payments: Collectors pay Myanmar Art Space directly. We hold the funds and release the payout to the Seller only after the order is confirmed and processed according to our payout schedule.

5. Shipping and Delivery

  • Responsibility: Unless otherwise stated by Myanmar Art Space, the Seller (Artist or Gallery) is responsible for packaging the artwork securely.
  • Costs: Shipping costs are calculated based on the Collector's location and the artwork's dimensions.
  • Risk: The risk of loss or damage passes to the Collector upon delivery. Sellers are advised to insure valuable shipments.

6. Returns and Disputes

  • Authenticity (Seller's Sole Responsibility): Sellers guarantee the authenticity of all artworks listed. The Seller bears sole legal and financial responsibility for the authenticity of their works. If a piece is proven to be a forgery or a misrepresentation, the Seller is solely liable to provide a full refund to the Collector. Myanmar Art Space is not liable for authenticity claims but will facilitate the dispute resolution.
  • Damaged Goods: If artwork arrives damaged, Collectors must contact support@myanmarartspace.net within 48 hours of delivery with photographic evidence.
  • Change of Mind: Returns for "change of mind" are generally not accepted unless specifically offered by the individual Seller.

7. User Conduct

We are a community-focused platform dedicated to the appreciation of art. To maintain a safe environment, the following are strictly prohibited:

  • Harassment & Hate Speech:Any form of harassment, bullying, or hate speech
  • Sensitive Topics:Content or comments that incite conflict regarding political, religious, or ethnic issues. Myanmar Art Space maintains a neutral stance and will remove content that disrupts community harmony.
  • Fraud:Spamming, fraudulent activity, shill bidding, or fake reviews.
  • Consequences:Violation of these rules will result in immediate account suspension or termination.

8. Limitation of Liability

Myanmar Art Space acts as an intermediary venue. We are not liable for the actions of users, the quality of artworks (beyond our authenticity guarantee procedures), or any indirect damages arising from the use of our site.
